Gang violence prevention act of 2009
Senator Williams submits, for himself and others
A BILL
To fix the root causes of gang violence whilst providing interim solutions to the problems caused by gang violence and gang activity
Section 1 Short Title
This act may be sited as the Gang violence prevention Act of 2009
Section 2 Definitions
A) The term “qualified county” shall be any county which:
(i) Has reported 5 gang related murders in the past year, as categorized by the county police department, or appropriate metropolitan police department
(ii) Has reported 15 or more incidents of non-lethal gang violence in the past year
(iii) Is declared to be so by the Governor of the state in consultation with the Attorney General
Section 3 Qualified county school grants
A) Any public high school in a qualified county may apply to the Department of Justice in close consultation with the Department of Education for a grant of not more than $2.5 million.
B) These grants may be used for but not limited to replacing old textbooks, initiating or expanding art and music programs, the purchase of new sporting equipment and the upgrading of old or dilapidated facilities.
Section 4 Community center construction
A) Each qualified county shall have constructed within it a community activity centre to provide:
(i) Counselling for families affected by gang violence
(ii) Activities for local youths
B) All community centers shall be visited on a weekly basis my officers of the county police departments to foster community, police relations.
Section 5 Police equipment enhancement
A) All police departments operated in qualified counties shall be required to outfit their officers with at least one non-lethal forms of disabling suspects. These may include but shall not be limited to electric stun guns or any kind of rapid hardening non-toxic foam. In addition these shall be in addition to, rather than replacing conventional firearms. Finally all police officers shall be encouraged to use non-lethal forms of disabling suspects wherever practicable and appropriate.
Section 6 Firearm cash rebate
A) Any firearm handed into a police station in a qualified county for destruction will bring a $100 cash rebate to the presenter of the aforementioned firearm.
Section 7 Approprations
A) $500,000,000 is hereby appropriated to the Department of Education for school upgrade grants.
B) $200,000,000 is hereby appropriated to the Department of Housing and Urban Development for the construction of community centres.
C) $150,000,000 is hereby appropriated to the Department of Justice for the purpose of purchasing non-lethal forms of disabling suspects and providing cash rebates for firearms.
