A BILL
To treat the Tuesday next after the first Monday in November in the same manner as any legal public holiday for purposes of Federal employment, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Election Tuesday Act of 2009'.
SEC. 2. TREATMENT OF ELECTION DAY IN SAME MANNER AS LEGAL PUBLIC HOLIDAY FOR PURPOSES OF FEDERAL EMPLOYMENT.
For purposes of any law relating to Federal employment, the Tuesday next after the first Monday in November in 2010 and each even-numbered year thereafter shall be treated in the same manner as a legal public holiday described in section 6103 of title 5, United States Code.
SEC. 3. STUDY BY COMPTROLLER GENERAL OF IMPACT ON VOTER PARTICIPATION.
(a) In General- The Comptroller General shall conduct a study of the impact of section 2 on voter participation.
(b) Report- Not later than May 1, 2014, the Comptroller General shall submit a report to Congress and the President on the results of the study conducted under subsection (a).
SEC. 4. SENSE OF CONGRESS REGARDING TREATMENT OF DAY BY PRIVATE EMPLOYERS.
It is the sense of Congress that private employers in the United States should give their employees a day off on the Tuesday next after the first Monday in November in 2010 and each even-numbered year thereafter to enable the employees to cast votes in the elections held on that day .
SEC. 5. SENSE OF CONGRESS REGARDING TREATMENT OF DAY AS HOLIDAY BY ALL RELEVANT AUTHORITIES
It is the sense of Congress that Election Tuesday should be a day of civic celebration and promotion of American values. As such, Congress encourages the Federal government, state governments, and local governments to treat this holiday as an opportunity to highlight and promote civic duty, with particular attention paid to the importance of voting within a democratic society. Additionally, the Congress encourages Americans of all types to organize and engage in festivities appropriate to the nature of our great republic, including but not limited to musical displays, historical presentations, public lectures and other, similar events.
SEC. 6. RESCHEDULING AND RENAMING OF CONSTITUTION DAY
In the interests of not hindering the operations of the Federal and local governments within the United States, Congress is resolved that the number of holidays recognized by the Federal Government should not be increased. Congress is, therefore, resolved that the holiday Constitution Day, formerly celebrated on September 17th, should be moved and incorporated into Election Tuesday as part of the civic celebration. All of the old celebrations and customs of Constitution Day would be included within Election Tuesday, and any and all former legislation concerning Constitution Day would still be considered to be active.
